1.       Copyright

Before buying a PDF version of your chosen standard, please note that all SABS standards are protected by copyright.  The following SABS (South African Bureau of Standards) Copyright Rules apply:

1.1     The downloaded standard will contain the name of the relevant person (usually the buyer) as a watermark on top of each page of the standard, which emphasizes the fact that a single-user licence was purchased.

1.2     You may use a downloaded standard, which has a single-user licence, on one standalone PC only and one backup of the PDF standard is permitted.

1.3     You may not change the contents of any of the standards.

1.4     You may not use the contents of a standard in another document or product without the permission of the SABS.

1.5     You may only make one printout of a standard.

1.6     You may not replicate a standard (in hard or soft copy format) by any means.

1.7     The SABS reserves the right to build DRM (Digital Rights Management) features into their products in order to stop attempts at illegitimate duplication.

2.       Electronic Communication

2.1   General:   When a customer or user visits the SABS Website or Webstore, or sends email to the SABS, he consents to receiving communication from the SABS electronically but understands that all forms of messages sent by the SABS satisfy the legal requirements for such communication in the relevant legislation.

 2.2  Disclaimer:  The South African Bureau of Standards (SABS) hereby distances itself from and accepts no liability in respect of the unauthorized use of its e-mail facility or the sending of email communications for other than strictly business purposes.  SABS furthermore disclaims liability for any unauthorized instruction for which permission was not granted and any opinions or recommendations expressed herein are those solely of the author.  Any recipient of an unacceptable communication, chain letter or offensive material of any nature is requested to report this to servicedesk@sabs.co.za .  Finally, recipients should check all e-mails and any attachments sent from the SABS for the presence of viruses.   The SABS accepts no liability for any damages that result from damage caused by any virus transmitted by email messages.

3.       Prices and fees

3.1   The net price of each standard is displayed when searching or when categories are navigated.

3.2   VAT is levied on all standards and products.  Overseas customers have the right to reclaim VAT payment.

4.      Agreement of Sale

4.1  The SABS subscribes to the Consumer Protection Act, no 68 of 2008.

4.2  Customers are advised to study the preview of standards before buying in order to insure that they purchase the standard suitable for them.

5.       Payment

5.1     Credit card and Instant EFT payments:  The SABS makes use of the services of a reputable third-party service provided for these services.   Should any enquiries arise,  the SABS will enquire via a terminal as to the nature of transactions.  If this proves unsatisfactory, the SABS undertakes to directly contact the service provider to establish the reasons for transactions not approved or released. 

5.2     Bank Transfer (EFT):    Customers are instructed to use the order number as reference number when making EFT (not instant EFT) payments.  Following the payment, customers have to allow up to 48 hours for these transaction to be approved and released.  EFT payments made on a Friday can at the earliest be released on a Monday following the weekend.   Customers must make the full payment for the product and the VAT and are not permitted to pay in the form of installments.

6.     Security

6.1    Any person who delivers or attempts to deliver any damaging code to this Webstore or attempts to gain unauthorized access to any page on the Webstore shall be prosecuted and civil damages shall be claimed in the event that SABS suffers any damage or loss.

6.2    The customer or user agrees and warrants that his login name and password shall only be used for personal use and shall not be disclosed to a third party.

6.3    The user allows the SABS to take all reasonable to ensure the integrity and security of the SABS Webstore and back-office applications.

7.        Disputes

In the event of any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this agreement, and not resolved through the Customer Relations Department of the SABS, such disputes shall be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa.  Arbitration proceeding shall be conducted in Pretoria in English.  The arbitration rules may be downloaded from www.arbitration.co.za/downloads/commercial_rules.pdf  

 8.       Severability

Any provision of this Agreement which is or may become illegal, invalid or unenforced shall be ineffective to the extent of such prohibition or unenforceability and shall be treated pro non scripto and severed from the balance of this Agreement, without invalidating the remaining provisions of this agreement.  This is subject to the severed clause not being material to the enforceability or existence of this Agreement.

9.   Applicable laws

All transactions or possible disputes are governed by the laws of the Republic of South Africa.
